These Terms & Conditions ("Terms") govern your use of the HomePage website (homepage.homes), the HomePage mobile application, and related services (collectively, the "Services"). By accessing or using HomePage, you agree to be bound by these Terms. HomePage is operated from Bengaluru, Karnataka, India.
1. Eligibility
You must be at least 18 years old and legally able to enter into a binding contract under Indian law to use HomePage. By using the Services you represent that you meet this requirement.
2. Account registration
- You must provide accurate, current and complete information.
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activity that occurs under your account.
- Notify us immediately of any unauthorised use.
3. Zero brokerage policy
HomePage operates on a strict zero brokerage policy. We do not charge brokerage to buyers, sellers, tenants or owners on any transaction facilitated through the platform. Optional value-added services (legal verification, painting, plumbing, electrical, interiors, packers) may be priced separately and are clearly disclosed before purchase.
4. Listings & user content
- You must own (or be authorised to list) any property you post.
- Listing content (photos, descriptions, pricing) must be accurate and not misleading.
- Listings that are duplicate, fraudulent, or violate Indian law will be removed.
- You grant HomePage a non-exclusive, royalty-free licence to display your listing within the Services.
5. Verification & due diligence
HomePage verifies listings within 1 hour as a service quality measure. Verification confirms identity and ownership documentation submitted by the lister; it is not a guarantee of title, condition, or fitness for purpose. Users are responsible for their own due diligence (legal, technical, financial) before transacting.
6. Prohibited use
You agree not to:
- Post fraudulent, misleading or duplicate listings
- Use HomePage to circumvent payments or solicit brokerage
- Scrape, reverse-engineer, or copy the Services
- Upload malware, spam, or content that violates intellectual property rights
- Impersonate any person or entity
- Harass, threaten or defame other users
7. Transactions between users
HomePage is a platform that connects buyers, sellers, tenants and owners. Contracts (sale deeds, rental agreements, lease deeds) are between the users themselves. HomePage facilitates documentation, e-stamping and registration but is not a party to those contracts unless expressly stated.
8. Fees for paid services
While listing and basic search are free and zero brokerage, certain bundled services (legal verification packages, painting, plumbing, electrical, interiors, packers) are paid. Prices are displayed before you purchase. All fees are inclusive of applicable Indian taxes unless stated otherwise.
9. Cancellations & refunds
Refund eligibility depends on the service purchased and the stage at which cancellation is requested. Refunds, where applicable, are processed within 7–14 working days to the original payment method. Detailed terms are shown at the point of purchase.
10. Intellectual property
The HomePage name, logo, software, design, content and trademarks are owned by HomePage. You may not use them without our prior written consent. User-submitted content remains owned by the user, subject to the licence in Section 4.
11. Disclaimer of warranties
The Services are provided "as is" and "as available". To the maximum extent permitted by Indian law, HomePage disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation.
12. Limitation of liability
To the maximum extent permitted by law, HomePage's total liability arising out of or in connection with the Services shall not exceed the greater of (a) the amount you paid HomePage in the twelve months preceding the claim, or (b) ₹10,000. HomePage is not liable for indirect, incidental, consequential or punitive damages.
13. Indemnity
You agree to indemnify and hold harmless HomePage, its officers, employees and partners from any claim arising out of (i) your use of the Services, (ii) your breach of these Terms, or (iii) your violation of any third-party right, including any property, contractual or intellectual property right.
14. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, if you violate these Terms or applicable law. You may stop using the Services at any time.
15. Governing law & jurisdiction
These Terms are governed by the laws of India. Subject to applicable consumer-protection laws, the courts at Bengaluru, Karnataka shall have exclusive jurisdiction over any dispute.
16. Changes to these Terms
We may revise these Terms from time to time. The "Last updated" date reflects the most recent revision. Continued use of the Services after a change constitutes acceptance.
